Chapter 388-828 WAC

DDA is planning to amend sections in chapter 388-828 WAC (the Supports Intensity Scale (SIS-A) portions of the DDA assessment) to align with updates the American Association of Intellectual and Developmental Disabilities (AAIDD) has made to its SIS-A assessment tool, Second Edition. Aligning with AAIDD’s Second Edition will not impact the algorithm. During the course of this review, the department may make additional changes that are necessary to improve clarity or update policy, and other related rules as may be required.

Chapter 388-848 WAC

New chapter 388-848 WAC and other related rules as may be required. DDA is planning to write a new chapter of rules to regulate its civil transitions program, which was created under ESSSB 5440, which amended RCW 10.77.060. During the course of this review, the department may make additional changes that are necessary to improve clarity or update policy.

WAC 388-101D-0295 & 388-101D-0330

DDA is planning to amend these rules to address the labeling of prescribed medications for clients. During the course of this review, the department may make additional changes that are necessary to improve clarity or update policy.

The department is proposing to amend WAC 388-829-0040, 388-829-0050, 388-829-0065, and 388-101D-0105, and may amend other related rules as may be required. DDA is planning to amend these rules to ensure providers complete the skills-demonstration portion of CPR training in person.

Chapter 388-826 WAC

Chapter 388-826 WAC and other related rules as may be required and to update provider certification requirements and other service delivery requirements. During the course of this review, the Department may make additional changes that are necessary to improve clarity or update policy.

DDA is considering amending rules from these chapters in order to update lists of available services, their names, descriptions, limits, and qualified providers, and to increase the individual and family service award amounts. During the course of this review, the Department may make additional changes that are necessary to improve clarity or update policy.

Chapter 388-825A WAC

New chapter within DDA’s portion of Title 388 WAC and other related rules as may be required. DDA is planning to write a new chapter of rules that will establish the process for certifying DDA providers not otherwise certified by Residential Care Services. During the course of this review, the department may make additional changes that are necessary to improve clarity or update policy.

Chapter 388-850 WAC

DDA is planning to amend Chapter 388-850 WAC and other related rules as may be required. DDA is planning to amend these rules to: increase the percentage of a county’s allocated funds for county administrative expenses; remove text that duplicates requirements dictated by statute; and update the distribution formula and other outdated service names and processes. During the course of this review, the department may make additional changes that are necessary to improve clarity or update policy.

WAC 388-825-206

DDA is planning to repeal WAC 388-825-206 and write a new chapter of rules for enhanced respite services. During the course of this review, the department may make additional changes that are necessary to improve clarity or update policy.

DDA is planning to amend these rules to comply with federal background check requirements and align rules with recent amendments to state law passed under Senate Bill 5252. DDA is planning to amend these rules to distinguish more clearly between client rights guaranteed by Washington state statute and federal Medicaid requirements for delivering services in integrated settings. DDA is planning to amend WAC 388-829-0087 to extend due dates for continuing education credits required under chapter 388-829 WAC and other related rules as may be required. DDA is planning to amend these rules to implement changes to home and community-based waivers as approved by the Centers for Medicare and Medicaid Services and to align with RCW 71A.12.280. Chapter 388-833 WAC

The department is planning to amend this chapter to allow DDA-contracted entities to provide Intensive Habilitation Services for Children. During the course of this review, the Department may make additional changes that are necessary to improve clarity or update policy.

Chapter 388-829Z WAC

DDA is planning to create a new chapter of rules to regulate the emergency transitional support services provided at Rainier School. These services were created in direct response to the COVID-19 public health emergency. With the declared state of emergency ending, these rules are intended to inform clients about the service they are receiving and the future of that service. During the course of this review, the Department may make additional changes that are necessary to improve clarity or update policy.

DDA is planning to amend Chapters 388-829C and 388-829R WAC and other related rules as may be required to allow companion home providers to access respite through overnight planned respite services providers and to access planned respite from residential habilitation centers. DDA is planning to amend rules in Chapters 388-825 and 388-101D WAC to align with amendments made by ALTSA to Chapters 388-71 and 388-113 WAC regarding background checks, individual providers, and home car agencies. DDA is also planning to amend sections in chapters 388-825 and 388-845 WAC to implement the consumer-directed employer program and align with changes being made to modernize the CARE system.
