The department is planning to amend WAC 388-71-0752, 388-71-1055, 388-112A-0090, 388-112A-0495, 388-112A-0610, 388-112A-0611, 388-112A-0612, 388-112A-1240, and 388-112A-1245. The purpose of the amendments is to update training rules to recognize registered nurses licensed under chapter 18.80 RCW, the new interstate nurse licensure compact. Other minor edits related to grammar and consistency are also included.

The Department intends to repeal WACs 388-71-0876, 388-71-0992, 388-112A-0081, and 388-112A-0613. The purpose is to remove the COVID-19 training and continuing education extension rules that are no longer necessary.

The department is seeking to repeal WAC 388-76-10060, Application—Department orientation class—Required. The department is seeking to repeal this rule because the training course no longer meets the intended purpose.

WACs 388-71-0906, 388-71-0911, 388-112A-0310 & 388-112A-0320

The purpose of the amendments is to remove references to HIV/AIDS training from the basic training requirements from existing rules. Rules referencing HIV/AIDS training are no longer required. In June of 2020, the legislature passed chapter 76, Laws of 2020 (ESHB 1551) which repealed RCW 70.24.270 requiring health professionals to receive education and training related to HIV/AIDS. The session law also removed references to HIV/AIDS in general, and added the definition of “blood borne pathogens” to include HIV, Hepatitis B, and Hepatitis C. The WAC amendments are necessary to establish current training requirements.

The department is implementing changes to WAC 388-113-0020 related to the passage of Substitute House Bill 1411 passed in the 2021 Legislative Session. The effective date of the bill was July 25, 2021. The rule is currently in effect by emergency adoption under WSR 21-16-068.
